This website is owned and operated by Being Balanced Consultancy Ventures, a partnership concern, incorporated under the provisions of the Companies Act, 2013 and having its registered office at Bengaluru, Karnataka State, India.

1. Use of the Service:

a) You must be at least 18 years old, or have the consent of a legal guardian/parent if you are under 18 years of age, to use our services. We will not be liable for any harm caused to you on account of any use of our website without appropriate parental consent.

b) You agree to provide accurate and current information during the registration process.

c) You are responsible for maintaining the confidentiality of your account and password.

2. Privacy Policy:

3. Consultation Fee/Payments:

a) Some services, like consulting with a counselor, are chargeable services and will require payment of fees. By selecting a paid feature, you agree to pay the specified fees.

b) All payments are to be made in advance and non-refundable, unless explicitly stated or discussed.

c) Fees will be modified periodically and communicated to Clients via formal channels.

d) While making a payment transaction, we will not be responsible or assume any liability, arising directly or indirectly to you due to any payment issues arising out of the transaction or decline of such transaction for any reason, as these services are provided by payment gateways and need to be directly addressed with them.

4. Booking Sessions:

a) You can consult with a counselor by booking a session, at least 24 hrs before the scheduled session time.

b) You can cancel or reschedule a session up to 12 hours before the scheduled time by informing us about the same.

c) If you do not turn up for a scheduled paid session, with no prior notice, we will consider it as a no-show and session fees will be forfeited.

5. Communication:

For all administrative matters, including scheduling, cancellations, rescheduling, payment queries, invoices, or sharing documents, please use email only.

Scheduling requests, cancellations, rescheduling requests, payment queries, or document-sharing requests sent through WhatsApp may not be responded to. These requests should be sent by email so that they can be tracked and handled appropriately.

If you need to discuss concerns between sessions, please email your therapist with a brief note. These concerns will usually be discussed in your next scheduled session. Therapy-related concerns are best addressed within the therapy space, where they can be explored with adequate time and attention.

Responses to emails or messages may sometimes be delayed due to clinical work, scheduled sessions, supervision commitments, weekends, public holidays, or therapist leave. We aim to respond to administrative queries by the end of the working day wherever possible.

If you do not receive a response within 48 hours, please send a follow-up email so that we can rule out any technical issue in email delivery.

When therapists are on scheduled leave or vacation, responses may be delayed. Wherever possible, therapists will inform clients in advance about planned breaks, vacations, or periods of reduced availability.

Please note that Being Balanced does not provide 24/7 crisis support. If you are in immediate danger or experiencing a mental health emergency, please contact your emergency contact, nearest hospital, local emergency services, or a crisis helpline.

6. Termination of Therapy

Participation in therapy is voluntary. You have the right to discontinue therapy at any time and for any reason.

While you may choose to end therapy without prior notice, we strongly recommend having at least one closing session. A closing session allows us to review your progress, reflect on the work done, discuss future goals, identify ongoing support needs, and create a healthy sense of closure.

Being Balanced or the therapist may also decide to pause, refer, or terminate therapy if it is clinically appropriate or ethically necessary to do so. This may include situations where:

a) The current therapeutic approach is no longer beneficial or suitable for your needs.

b) Your needs are outside the therapist’s scope of competence or the services offered by Being Balanced.

c) There is a consistent failure to follow agreed-upon therapy policies.

d) There are repeated late cancellations, missed sessions, or no-shows.

e) There is non-payment of fees or repeated delay in payment.

f) There is abusive, threatening, sexually inappropriate, discriminatory, or unsafe conduct toward the therapist, staff, or any representative of Being Balanced.

g) There is a conflict of interest, boundary concern, or other ethical reason that makes continuation of therapy inappropriate.

Wherever possible, termination will be discussed with you in advance, and appropriate referrals or alternative support options may be suggested. However, in cases involving safety concerns, serious boundary violations, non-payment, or abusive/inappropriate conduct, therapy may be terminated immediately.

7. Prohibited Conduct:

a) You confirm that the information you provide to Being Balanced through the website, forms, email, phone, messaging platforms, booking systems, or any other communication channel is true, accurate, current, and complete to the best of your knowledge.

b) You may not upload, download, post, distribute, or transmit any content that is threatening, defamatory, harassing, abusive, unlawful for or on behalf or against our services or website.

c) You shall not gain unauthorized access to or engage in any activity that interferes with or disrupts others from accessing the service or functioning of our website.

d) You will use polite and courteous language during interactions and treat the counselor with respect.

e) Any form of abusive, threatening, intimidating, discriminatory, sexually inappropriate, obscene, harassing, coercive, or exploitative language or behaviour towards the counsellor is strictly prohibited. Being Balanced reserves the right to refuse, pause, suspend, or terminate services immediately in the event of such conduct, without prejudice to any other rights or remedies available under applicable law. Where necessary, Being Balanced may also take appropriate protective, legal, or reporting action.

8. Intellectual Property:

a) All content, features, functionality and materials (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof) available on the website are and will remain the exclusive property of Being Balanced Consultancy Ventures and its licensors.

b) You agree not to reproduce, distribute, or create derivative works of the content available on our website without our prior written consent.

9. Disclaimer of Warranties:

a) The use of our website, its content and any services or tools obtained through the website is at your own risk and are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied.

b) We do not warrant that the service will be error-free, secure, uninterrupted or as expected and therefore will not be liable for any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any such content.

10. Limitation of Liability:

Being Balanced Consultancy Ventures, its affiliates or licensors will not be liable for any indirect, incidental, special, or consequential damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, arising out of or in any way connected with the use of the Service.

11. Governing Law:

These terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions and any dispute that may arise out of the use of this site shall be the exclusive jurisdiction of the courts in Bangalore.

12. Changes to Terms & Conditions:

a) We reserve the right to modify or replace these Terms & Conditions at any time. Any such modifications will become effective immediately upon posting to the Website.

b) Your continued use of the Service after any changes indicates your acceptance of the updated terms. You are expected to check this page from time to time or each time you access this website so that you are aware of any changes, as they are binding on you.
